2009 "Case of The Year" Submissions

     The following cases were submitted by Deputy Chad Brubaker of the Fauquier County Sheriff's Office in consideration for the 2009 "Case Of The Year" Award. These are ordered by the case occurrence date. Some of the cases may have had names or addresses removed to protect identities for cases that have not been resolved through the court system. All suspects are presumed innocent until convicted in a court of law. These cases are from official reports submitted by the officer for cases that meet the criteria for the 2009 "Case Of The Year".


Burglary

    On 2/21/09 at approximately 2207 hours Deputy Brubaker was requested to assist with an alarm at 11532 James Madison Street.
         The responding deputies located a hole in the ceiling and it was apparent that the store had been burglarized. Upon arrival I assisted Deputy Pennington with processing the scene and collecting evidence. Once I finished assisting with the evidence collection I deployed my tracking/trailing certified K9 Rik and prepared him for a track/trail.
         It was apparent by the security tape that the suspects had left from the rear door of the store but it was not apparent if they got into a vehicle or fled on foot. Once K9 Rik was prepared I gave him the command to track/trail at the rear door where the suspects fled. K9 Rik did not immediately track/trail at the door but continued to cast in the rear of 11532 James Madison Street but did show a distinct change in behavior near the rear 11534 James Madison Street. Directly behind 11532 James Madison Street is a shed type structure where K9 Rik began to settle into a good tracking stance and show very distinct tracking/trailing behavior. Once near the area marked as number 1 on the attached map I located two empty boxes of cigars. Cigars had been stolen from the store.
         At that point I did not have a cover officer due to the fact that I was casting and looking for a track. I requested a cover officer at that point and Deputy Pennington arrived at my location and I continued with the track, The track continued along a old wooded fence row eventually coming to a turn in the fence. I placed K9 Rik over the fence and he continued to track until he came to the area marked with the number two on the attached map where a latex glove was located. Deputy Pennington had collected several gloves of the same type in the store prior to assisting me with the track. K9 Rik at this point began to circle in the area as if he was having a difficult time reacquiring the track. I continued to allow K9 Rik to work the area until he again located the track. While heading in the direction indicated on the attached map there were several more pieces of the plastic gloves that we located in the store. K9 Rik continued across a grass field eventually coming to the area marked with number 3 on the attached map where I located a plastic bag hanging on the fence adjacent to James Madison Hwy. K9 Rik continued to work the area as if he was in human scent. Deputy Pennington also observed the unique behavior that K9 Rik was displaying and advised me that K9 Rik had possible located something on ground. After lighting the area K9 Rik had located a cell phone that been dropped by the fleeing suspects. I advised Sergeant Lucas of the evidence find and Deputy Pennington photographed and collected the evidence.

    Narcotics

         On 10/30/09 at approximately 1625 hours MDS Brubaker was advised of a robbery in progress in the 4200 Block of Aiken Drive.
         While enroute the caller Michael Adams advised WFJCC that two black males attempted to get into his vehicle and take items from him. Adam advised that the suspects fled in a known direction and was waiting for me to arrive to report the incident.
         Upon arrival I made contact with Adams who advised that two black males flagged him down on Aiken Drive as if they needed some kind of assistance. Adams advised that he stopped and the suspects approached the vehicle and attempted to get in advising Adams to give them all of his stuff. Adams advised that he drove off so that the suspects could not get into his vehicle. I had Adams show me the last place that he saw the males run to. Adams directed me to an area just off of Aiken Drive between two buildings. Adams then advised they may have ran across a nearby parking lot. Adams then advised that they definitely ran between the two buildings.
         I deployed my tracking/trailing certified K9 Rik and prepared him for the tracking/trailing. I gave K9 Rik the command to track/trail in the area where Adams advised the subjects had ran. K9 Rik was not able to locate a track in that area so I continued to cast in the area eventually working to the parking lot area where Adams advised the subjects did not flee. Once in that area I observed a change in behavior and K9 Rik settled into a good track. K9 Rik continued across various paved lots as well as grassy areas. The track was confirmed by footprints in a muddy area at the edge of one of the parking lots. The track continued eventually coming to Rogues Road. K9 Rik worked across the roadway to the driveway of 7415 Rogues Road. Once in the driveway K9 Rik worked his way to the door of the duplex.
         DFC Moline and MDS Harner were at the residence with me and advised them that I was going to the rear of the residence before they attempted contact. I walked around the residence to make sure that no one fled from the rear. As I made the turn to the rear of the residence I located two black males matching the description that Adams provided. I ordered the males that were later identified as Alex Brooks and Corey Davis to the ground and advised WFJCC that I had located the subjects. Deputy Moline and MDS Harner secured the subjects and searched them. Deputy Moline located a small amount of marijuana on Brooks and MDS Harner located a small amount of marijuana on Davis.
         After securing both of the subjects I had Sergeant Lucas bring Adams to the residence to identify the subjects that were involved in the robbery. I first spoke with Brooks and asked him if he knew why we had taken into custody. Brooks advised that he thought it was because he had an altercation with a "guy." Brooks went on to explain that he had a disagreement over the purchase of marijuana with Adams. Brooks advised that he left school at KRHS and walked to Adams address on Moonlight Ct and met with Adams. Brooks then advised that he got into a vehicle with Adams with the intention of trying to buy marijuana from anyone they could find to buy it from. Brooks then advised that the two left Moonlight Ct. and went to the residence where Brooks lives at and picked up Davis. Brooks advised that Adams and Davis made several calls and made a deal to purchase marijuana from a subject at the 7-11 in New Baltimore. Brooks advised that three of them went to the bank so that Adams could get the money to purchase the marijuana. The three then met a subject and purchased marijuana at the 7-11. Brooks advised that Adams went into the 7-11 to purchase something and Davis and Brooks started to talk. Brooks advised that he and Davis had been shorted by Adams in the past and they decided to take Adams marijuana and leave the area. Brooks advised that they got a ride back to the Vint Hill area and were dropped off and began to walk back to Brooks residence. Brooks advised that Adams located them and began to argue. Brooks advised that he and Davis got into the truck and the argument escalated until Brooks and Davis exited the vehicle. Brooks advised that he left his hooded sweatshirt in the truck following the argument. Brooks and Davis continued to walk in the area and ran into Adams again. This time Brooks advised that Adams threw his hooded sweatshirt from the vehicle as he passed.
         I next spoke with Davis who gave the same exact description of the days event that Brooks did. Davis was very forthcoming with the information and admitted that they took the marijuana from the glovebox of Adams vehicle and left the area.
         After speaking with both Davis and Brooks I spoke with Adams and asked him again what had taken place. Adams continued to deny that he knew the subjects and that they tried to rob him. I confronted Adams with the version of the days events that Brooks and Davis provided and Adams advised that he had lied about what had taken place and that he was never robbed. Adams advised that he was upset because he spent money on marijuana and Brooks and Davis took it from him. Adams advised that he made the story up to try get back at Brooks and Davis for taking his marijuana. Adams admitted that he transported both juveniles with the intention of purchasing marijuana and had done the same thing in the past.
         Brooks was turned over to his mother Susan Brooks and advised a petition for possession of marijuana would be obtained. Davis was turned over to his mother Nicole Thornley and advised that a petition for possession of marijuana would be obtained.
         Adams was transported to the Magistrates office and taken before mag. Bailor for a hearing. Mag. Bailor issued warrants for reporting a false crime and two counts of contributing to the deliquency of a minor. Adams was held on a $4000 secured bond and turned over to ADC staff to be processed.
